We reserve the right to limit the quantities of any products or services we offer, to change product descriptions or pricing at any time without notice at our sole discretion, and to discontinue any product at any time. The Service includes cosmetic skincare products and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. Individual results may vary. Descriptions and claims on this website relate to the general properties of the ingredients and are not intended as medical advice. Art of Skin Care is not responsible for any adverse reactions resulting from misuse of the Service or a failure to follow product instructions.

Section 7 – Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made.

We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Account Security

You are responsible for maintaining the confidentiality of your account credentials, including your username and password. You are responsible for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. Art of Skin Care will not be liable for any loss or damage arising from your failure to protect your account credentials.

Section 8 – Auto-Shipment and Subscription Orders

Art of Skin Care offers auto-shipment (subscription) programs that allow you to receive the Service on a recurring basis at a scheduled frequency. By enrolling in an auto-shipment program, you authorize us to charge your payment method on file at the agreed billing interval until you cancel.

Pricing

Subscription pricing is subject to change. We will notify you of any price changes before they take effect. Your continued participation in the auto-shipment program following notice of a price change constitutes your acceptance of the new pricing.

How to Cancel

You may cancel or modify your auto-shipment subscription at any time through your subscription portal or by contacting our customer service team:

Important: Cancellations must be submitted before your order has been processed and shipped. We are unable to cancel orders that have already been shipped. If your cancellation request is received after your order has entered fulfillment, the cancellation will take effect on your next scheduled shipment.

Cancellation Timing

We recommend submitting any cancellation or modification request at least 48 hours before your next scheduled order date to allow sufficient processing time. Your subscription portal will display your next scheduled order date.

Section 9 – Order Cancellation Policy

This cancellation policy applies to all orders, including one-time purchases and auto-shipment orders.

Orders may be cancelled before they have been processed and shipped. Once an order has shipped, it cannot be cancelled.

If your order has already shipped, you may initiate a return in accordance with our Return Policy once the package is delivered, subject to the conditions described in Section 11.

Section 10 – Shipping

We only ship to addresses within the United States. Shipping timeframes are estimates and are not guaranteed. Art of Skin Care is not responsible for delays caused by carriers, weather, customs, or other circumstances outside our control.

Risk of loss and title for products purchased from us pass to you upon delivery of the products to the carrier. It is your responsibility to file any claims with the carrier for damaged or lost shipments, though we will make reasonable efforts to assist you in resolving such issues.

Delivered Orders

If an order is marked as delivered by the carrier with proof of delivery, Art of Skin Care cannot issue a refund for that order. However, in our sole discretion and as a courtesy, we may offer a complimentary reshipment. If you believe your package was marked as delivered in error, please contact our customer service team within 7 days of the marked delivery date.

Section 11 – Returns and Refunds

Our return and refund policy is described in full on our Returns page. By making a purchase, you agree to the terms of that policy. Products must be returned in accordance with the conditions and timeframes described on that page. We reserve the right to refuse returns that do not meet the stated requirements.

Section 12 – Gift Cards

Art of Skin Care gift cards are available for purchase on our website and may be redeemed toward eligible purchases at artofskincare.com.

Gift cards do not expire and have no inactivity fees, as required by applicable law.
Gift cards are non-refundable and may not be redeemed for cash, except where required by law.
Lost, stolen, or damaged gift cards will not be replaced unless you can provide proof of purchase. Art of Skin Care is not responsible for unauthorized use of a gift card.
Gift cards may not be used to purchase other gift cards.
If your order total exceeds the gift card balance, the remaining amount must be paid with another payment method.
Art of Skin Care reserves the right to cancel a gift card if we believe it was obtained fraudulently.

Section 13 – Rewards Program

Art of Skin Care operates a rewards program that allows eligible customers to earn and redeem points on qualifying purchases. Full details on how points are earned, tier structures, and current reward offerings are available on our Rewards page. By participating in the rewards program, you agree to the terms set out below. We reserve the right to modify, suspend, or discontinue the rewards program, or any aspect of it, at any time without prior notice.

Earning Points

Points are issued for every dollar spent on qualifying purchases, excluding taxes and shipping costs. Points are not earned on gift card purchases. Points will be credited to your account after your order is placed and may take a short time to appear in your balance.

Points Redemption

Points may be redeemed in the following ways:

Free Product Redemption: Points may be redeemed for one of the rotating free products displayed on our Rewards page. The selection of available products may be changed at any time at our sole discretion. Products redeemed through the Rewards page are final sale and are not eligible for return, exchange, or refund.
Checkout Discount: Points may be applied as a discount at checkout, up to a maximum of $20.00 off a single order. The minimum redemption is 200 points ($1.00 in value, at a rate of 200 points per $1.00 discount).

Point redemptions of either type may be combined with shipping discounts and product discounts or promotional codes.

Points Transfer

Rewards points are non-transferable between separate customers. Points may only be moved between accounts in the event of an email address or name change on your existing account. To request an account update of this type, please contact our customer service team. We may require verification of account ownership before processing any changes.

Points Expiration

Points will expire if your account has no completed orders on our website for a period of 12 consecutive months. Upon expiration, all accumulated points will be forfeited with no further notice.

Points Adjustments for Returns and Refunds

If you return or receive a refund for an order on which points were earned, the corresponding points will be deducted from your rewards balance. If this results in a negative balance, future earned points will be applied to offset the deficit before becoming available for redemption.

Referral Program

You may earn bonus points by referring new customers to Art of Skin Care. The following conditions apply to all referrals:

New customers only: Referral bonuses apply only when the referred person is a new customer with no prior order history with Art of Skin Care.
Minimum qualifying order: The referred customer must place a qualifying order of at least $50.00 (before taxes and shipping) for the referral bonus to be issued.
Single use per referral link: Each referral link you generate may only be used once. You must generate a new referral link for each person you wish to refer.
Self-referral is prohibited: If a referred order shares the same shipping address, billing address, or other identifying account information as your own account history, it will be considered a self-referral. Any bonus points issued for a self-referral will be reversed from your account.

Program Abuse

We reserve the right to remove any customer from the rewards program if we determine, in our sole discretion, that they are abusing the program. Examples of abuse include, but are not limited to:

Subscribing to products with the intent to cancel or refund in order to collect subscription bonus points.
Self-referral or creating multiple accounts to generate fraudulent referral bonuses.
Any other conduct intended to game, manipulate, or circumvent the rewards system.

Removal from the rewards program does not affect your ability to continue placing orders with Art of Skin Care. Any unredeemed points will be forfeited upon removal.

Section 14 – Promotional Codes and Offers

Promotional codes and discount offers issued by Art of Skin Care are subject to the following conditions unless otherwise stated:

Promotional codes are valid for one-time use per customer unless otherwise specified.
Codes may not be combined with other promotions, discounts, or offers unless explicitly stated.
Codes are non-transferable and have no cash value.
Art of Skin Care reserves the right to expire, modify, or revoke any promotional code at any time.
Fraudulent use of promotional codes may result in order cancellation and termination of your account.

Section 15 – Intellectual Property

All content on this website, including but not limited to text, graphics, logos, images, product descriptions, and software, is the property of Art of Skin Care or its content suppliers and is protected by applicable intellectual property laws, including United States copyright and trademark law. The Art of Skin Care name, logo, and all related marks are trademarks of Art of Skin Care, Inc.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website without our prior written consent, except as necessary for your own personal, non-commercial use.

Section 16 – Optional Tools

We may provide you with access to third-party tools over which we neither monitor nor have any control or input. You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations, or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use of optional tools offered through the site is entirely at your own risk and discretion.

We may also, in the future, offer new services and/or features through the website. Such new features and/or services shall also be subject to these Terms of Service.

Section 17 – Third-Party Links

Certain content, products, and services available via our Service may include materials from third parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of third-party websites, and we do not warrant and will not have any liability or responsibility for any third-party materials, websites, products, or services.

We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. We may, but have no obligation to, monitor, edit, or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable, or that violates any party’s intellectual property or these Terms of Service. You agree that your comments will not violate any right of any third party, will not contain libelous or otherwise unlawful, abusive, or obscene material, and will not contain any computer virus or other malware. Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times, and availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

In no case shall Art of Skin Care, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of any of the Service or any products procured using the Service. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Section 24 – Force Majeure

Art of Skin Care shall not be liable for any failure or delay in the performance of our obligations under these Terms of Service to the extent such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, acts of government, supply chain disruptions, carrier delays, labor disputes, or failures of third-party infrastructure. We will make reasonable efforts to notify you of any such delay and to resume normal operations as soon as practicable.

You agree that any legal action or proceeding arising under these Terms of Service shall be brought exclusively in the state or federal courts located in Sacramento County, California, and you hereby consent to the personal jurisdiction and venue of such courts.

Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in any court of competent jurisdiction where necessary to prevent irreparable harm.

Section 26 – Governing Law

These Terms of Service and any separate agreements whereby we provide you the Service shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Section 27 – Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use the Service, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to the Service (or any part thereof).

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
